But its <strong>application<\/strong> will change in scale.<\/p>\n<p id=\"ember4082\" class=\"ember-view reader-text-block__paragraph\">After years of education, the European authorities will enter a phase of more systematic control, with a clear deterrent rationale: <strong>sanctions will become a standardized regulatory lever<\/strong>.<\/p>\n<p id=\"ember4083\" class=\"ember-view reader-text-block__paragraph\">Control priorities will be very specific:<\/p>\n<ul>\n<li>the reality of consent (beyond the simple blindfold),<\/li>\n<li>effective minimization of the data collected,<\/li>\n<li>documentation of technical choices,<\/li>\n<li>transfers outside the EU,<\/li>\n<li>and the alignment between &#8220;privacy&#8221; rhetoric and actual practices.<\/li>\n<\/ul>\n<p id=\"ember4085\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Key point<\/strong>: in 2026, the question will no longer be &#8220;am I compliant on paper?&#8221; But: <strong>&#8220;would my compliance stand up to a technical audit?&#8221;<\/strong><\/p>\n<h2 id=\"ember4086\" class=\"ember-view reader-text-block__heading-2\">2) ePrivacy: the underestimated (yet decisive) front<\/h2>\n<p id=\"ember4087\" class=\"ember-view reader-text-block__paragraph\">While the ePrivacy Regulation remains blocked, <strong>the ePrivacy Directive is already active<\/strong> in national legislation.<\/p>\n<p id=\"ember4088\" class=\"ember-view reader-text-block__paragraph\">It governs terminal access: cookies, tracers, SDKs, local storage. Its strength: it applies as soon as a terminal is read or written, <strong>even if the data is not personal<\/strong> in the RGPD sense.<\/p>\n<p id=\"ember4089\" class=\"ember-view reader-text-block__paragraph\">The most frequent offences :<\/p>\n<ul>\n<li>tracers deposited before consent,<\/li>\n<li>refusal more complex than acceptance,<\/li>\n<li>premature activation of analytics\/advertising tools,<\/li>\n<li>dark patterns in consent interfaces.<\/li>\n<\/ul>\n<p id=\"ember4091\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>2026: mobile apps in the crosshairs<\/strong> Audits will extend to mobile: events sent as soon as opened, SDKs active before consent, advertising identifiers transmitted without legal basis.<\/p>\n<h2 id=\"ember4092\" class=\"ember-view reader-text-block__heading-2\">3) US-EU transfers: fragile stability<\/h2>\n<p id=\"ember4093\" class=\"ember-view reader-text-block__paragraph\">The <strong>Data Privacy Framework (DPF)<\/strong> has been securing certain transfers to the United States since 2023. But this stability is <strong>temporary<\/strong>.<\/p>\n<p id=\"ember4094\" class=\"ember-view reader-text-block__paragraph\">A <strong>Schrems III-type<\/strong> appeal is widely anticipated, as was the case for Safe Harbor and then Privacy Shield.<\/p>\n<p id=\"ember4095\" class=\"ember-view reader-text-block__paragraph\">Possible scenarios :<\/p>\n<ul>\n<li>DPF maintained but requirements tightened,<\/li>\n<li>partial invalidation (data types \/ sectors),<\/li>\n<li>total invalidation, implying a return to SCC and in-depth impact analysis.<\/li>\n<\/ul>\n<p id=\"ember4097\" class=\"ember-view reader-text-block__paragraph\">What organizations need to do now:<\/p>\n<ul>\n<li>precisely map flows to the US,<\/li>\n<li>identify European alternatives,<\/li>\n<li>prepare a switchover plan,<\/li>\n<li>reduce dependency wherever possible.<\/li>\n<\/ul>\n<p id=\"ember4099\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Key point<\/strong>: the DPF is a <strong>reprieve<\/strong>, not a final solution.<\/p>\n<h2 id=\"ember4100\" class=\"ember-view reader-text-block__heading-2\">4) Digital Omnibus: simplification&#8230; but also tightening<\/h2>\n<p id=\"ember4101\" class=\"ember-view reader-text-block__paragraph\">The <strong>Digital Omnibus<\/strong> project aims to streamline the stack of texts (RGPD, DSA, DMA, Data Act, AI Act&#8230;). But beware: simplifying does not mean lightening.<\/p>\n<p id=\"ember4102\" class=\"ember-view reader-text-block__paragraph\">We can expect :<\/p>\n<ul>\n<li>more consistency between rules,<\/li>\n<li>fewer gray areas,<\/li>\n<li>more legible obligations that <strong>are easier to monitor<\/strong>,<\/li>\n<li>and more stringent requirements on system design (privacy by design, accountability, documentation).<\/li>\n<\/ul>\n<p id=\"ember4104\" class=\"ember-view reader-text-block__paragraph\">The<strong>AI Act<\/strong>, in particular, will strengthen transparency obligations on AI uses in analytics: scoring, prediction, personalization.<\/p>\n<p id=\"ember4105\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Key point<\/strong>: this framework won&#8217;t make compliance any easier&#8230; just <strong>less circumventable<\/strong>.<\/p>\n<h2 id=\"ember4107\" class=\"ember-view reader-text-block__heading-2\">2026: the end of approximation<\/h2>\n<p id=\"ember4108\" class=\"ember-view reader-text-block__paragraph\">In 2026, privacy will become <strong>measurable, verifiable and sanctionable<\/strong>.
